1. Overview
FluxDiagram LLC ("FluxDiagram") respects the intellectual property rights of others and complies with the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512 ("DMCA"). This page explains how to report copyright infringement on our platform, how we handle takedown notices and counter-notices, and our policy toward repeat infringers.
FluxDiagram generates animated visuals from user descriptions using AI. Users are responsible for ensuring their inputs and outputs do not infringe third-party copyrights or other intellectual property rights. See our Acceptable Use Policy for more details.
2. Filing a DMCA Takedown Notice
If you believe that content on FluxDiagram infringes your copyright, you may submit a written DMCA takedown notice to our designated DMCA agent. To be effective under 17 U.S.C. § 512(c)(3), your notice must include all of the following:
- Identification of the copyrighted work: A description of the copyrighted work you claim has been infringed. If multiple works are covered by a single notice, a representative list is acceptable.
- Identification of the infringing material: A sufficiently specific description of the material you claim is infringing and its location on FluxDiagram (e.g., a URL or animation ID) so that we can locate it.
- Your contact information: Your name, address, telephone number, and email address.
- Good faith statement: A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- Accuracy statement: A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of the exclusive right that is allegedly infringed.
- Physical or electronic signature: Your physical or electronic signature (typing your full name is sufficient as an electronic signature).
Warning:Submitting a false DMCA notice may expose you to liability under 17 U.S.C. § 512(f) for damages, including costs and attorneys' fees.

We acknowledge receipt of DMCA notices within 2 business days and take appropriate action within 10 business days.
3. Our Response to Takedown Notices
Upon receiving a complete and valid DMCA takedown notice, FluxDiagram will:
- Promptly remove or disable access to the allegedly infringing material
- Notify the user who uploaded or generated the allegedly infringing content that the material has been removed and the reason why
- Provide the user with information about filing a counter-notice if they believe the removal was in error
FluxDiagram acts expeditiously and does not require any determination of actual infringement before removing content in response to a facially complete notice.
4. Filing a Counter-Notice
If you believe your content was removed due to a mistake or misidentification, you may submit a counter-notice to our DMCA agent. Under 17 U.S.C. § 512(g), a valid counter-notice must include:
- Identification of the removed material: A description of the material that was removed and its location before removal (e.g., the animation ID or URL).
- Your contact information: Your name, address, telephone number, and email address.
- Statement under penalty of perjury: A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
- Consent to jurisdiction: A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside the United States, of any judicial district in which FluxDiagram may be found, and that you will accept service of process from the person who provided the original DMCA notice.
- Physical or electronic signature: Your physical or electronic signature.

If we receive a valid counter-notice, we will forward it to the original complainant and may restore the removed content within 10 to 14 business days after receiving the counter-notice, unless the complainant files a court action seeking to restrain you from engaging in infringing activity relating to the material.
Warning:Submitting a false counter-notice may expose you to liability for damages, including costs and attorneys' fees.
5. Repeat Infringer Policy
FluxDiagram has a policy of terminating accounts of users who are repeat infringers of third-party copyright. FluxDiagram tracks DMCA notices received per account. The following policy applies:
- First notice: The infringing content is removed; the user receives a warning.
- Second notice:The infringing content is removed; the user's account is placed under review and may be temporarily suspended.
- Third notice (or serious first offense):The user's account is permanently terminated. The user is banned from creating new accounts on FluxDiagram.
FluxDiagram reserves the right to accelerate this policy for egregious violations, including accounts that appear to be created specifically for infringing activity, or where the infringing material involves commercially significant works.
6. Copyright Policy for AI-Generated Outputs
FluxDiagram generates animated visuals using AI models based on user descriptions. We do not pre-screen generated content for copyright compliance. Users are solely responsible for ensuring their animation description inputs and the resulting Outputs do not reproduce copyrighted material without authorization.
FluxDiagram does not intentionally reproduce copyrighted logos, images, or branded content in its AI outputs. If you believe our AI system has reproduced your copyrighted work in an Output, please follow the takedown notice process described in Section 2.
